Form 7004
Application for Automatic Extension to File Business Income Tax Returns
A federal extension request granting additional time (typically six months, five and a half for some entities) to file most business income tax returns including Form 1120, 1120-S, and 1065.
Who Files Form 7004
Corporations, S corporations, partnerships, and most other business entities (including REITs, REMICs, and certain trusts) that need additional time to complete their business return. Form 7004 extends the time to FILE only, not the time to PAY.
What Form 7004 Reports
Form 7004 covers extensions for Form 1120, 1120-S, 1065, 1041 (estates and trusts get five and a half months), 1042, 1066, 8804, and others. The form asks for an estimated total tax liability and any payment being made with the extension. Filed electronically or by paper by the original due date of the underlying return.
Key Deadlines
- March 15: Form 7004 due for calendar-year S-Corps (Form 1120-S) and partnerships (Form 1065)
- April 15: Form 7004 due for calendar-year C-Corps (Form 1120) and most trusts (Form 1041)
- Extension is six months for most returns, five and a half months for Form 1041
Common Mistakes
- Believing the extension also extends the payment deadline (it does not, interest and penalties begin from the original due date)
- Estimating tax liability too low and incurring substantial interest by the extended deadline
- Filing Form 4868 (individual extension) for an entity return by mistake
- Missing state-level business extension forms
Best Practices
- File electronically through tax software, NOT by paper. Paper Form 7004 has been rejected for late processing in past years.
- Estimate the entity tax liability and pay any expected balance with the extension. The extension only delays filing, not payment.
- For partnerships and S-Corps, the extension is to September 15. For C-Corps and most trusts, it is to October 15. Confirm your entity-specific extended date.
- File the equivalent state extension separately. Most states have their own business extension form (e.g., California Form 7004-equivalent).
- Mark the calendar for the extended deadline NOW. Late filing penalties are 5 percent per month on K-1 partnerships and S-Corps, even with no tax due.
